Many products sold by The Watch VIP are pre-owned luxury watches. You acknowledge that pre-owned watches may show minor wear appropriate to age, and all conditions are described as accurately as possible.

Descriptions may change at any time without notice. We may discontinue products or limit quantities at our discretion.

SECTION 3 — ORDERS

By placing an order, you make an offer to purchase. The Watch VIP may accept or decline your order at its discretion. Payment must be processed before an order is accepted.

The Watch VIP does not process payments through Shopify Payments. All payments are handled directly via secure methods such as bank transfer, PayPal invoice, or other agreed channels.

You represent that purchases are for personal use, collection, investment purposes, or lawful resale, and not for fraudulent activity.

SECTION 4 — PRICES AND BILLING

Prices and promotions are subject to change without notice. Prices do not include taxes, shipping, handling, customs, or import fees unless stated.

You agree to provide accurate and current purchase information. You represent that the payment method provided is valid, authorized, and will be honored.

Delivery times are estimates only. We are not responsible for delays caused by carriers, customs, or events outside our control.

All shipments are fully insured through our third-party insurance partners (e.g., Parcel Pro, Secursus, or equivalent), and require adult signature upon delivery.

Title and risk of loss pass to you when the product is transferred to the carrier.

All trademarks, branding, images, text, and content on the Services belong to The Watch VIP or our licensors. You may not reproduce or use any content without our prior written permission.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

The Watch VIP is powered by Shopify. All purchases, however, are made directly with The Watch VIP. Shopify is not responsible for any transactions, injuries, or losses related to your purchases. You expressly release Shopify from all claims relating to your transactions with The Watch VIP.

SECTION 10 — PRIVACY POLICY

All personal information collected is subject to our Privacy Policy [LINK] and Shopify’s Privacy Policy. By using the Services, you consent to the processing and transfer of your information as described therein.

The Services and products are provided “as is” without warranties of any kind. Luxury watches may require periodic servicing depending on age and manufacturer guidelines.

Except as expressly provided in our Warranty Policy, we make no guarantees regarding long-term performance, accuracy, water resistance, or mechanical longevity.

SECTION 16 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, The Watch VIP shall not be liable for indirect, incidental, punitive, or consequential damages arising from your use of the Services or purchases.

SECTION 17 — INDEMNIFICATION

You agree to indemnify and hold harmless The Watch VIP, Shopify, and affiliates against claims arising from your breach of these Terms or unlawful use of the Services.

SECTION 18 — SEVERABILITY

If any provision is unenforceable, the remainder will remain in effect.

SECTION 19 — WAIVER; ENTIRE AGREEMENT

Failure to enforce a provision does not constitute a waiver. These Terms constitute the full agreement between you and The Watch VIP.

These Terms are governed by the laws of the State of Florida. Venue and jurisdiction shall lie in Florida courts, where The Watch VIP is headquartered in Winter Garden, Florida.

We may update these Terms at any time by posting changes. Continued use constitutes acceptance.

SECTION 25 — AUTHENTICITY & INSPECTION POLICY

The Watch VIP verifies the authenticity of every watch we sell using external and internal inspection methods. Each watch is documented and photographed prior to shipment.

Upon return, the same inspections are performed to ensure the watch returned is the same watch sold, in the same condition, and with the same components. We reserve the right to refuse refunds or warranty claims if we determine an item has been altered, tampered with, or returned with substituted or counterfeit parts.

SECTION 26 — WARRANTY POLICY (12-MONTH LIMITED WARRANTY)

All watches sold by The Watch VIP include a 12-month limited warranty covering mechanical or functional defects caused by parts or workmanship.

This warranty does not cover:

Accidental damage, impacts, drops, or misuse
Over-winding or improper operation
Water damage, including water ingress due to an unsecured crown or misuse beyond rated depth
Cosmetic wear (scratches, dents, strap wear, discoloration)
Unauthorized repairs or servicing
Loss, theft, or disappearance

All warranty repairs must be completed by The Watch VIP’s approved watchmakers unless otherwise approved in writing.
